Taxacom: Subspecies turns out to be valid species

Under the ICZN Code, the relevant portion is the "principle of
coordination" which in essence means that a name proposed at subspecies can
equally be re-used as a specific epithet as desired, without change of
ascribed authorship; same for subgenera and genera, subfamilies and
families (also tribes and other ranks assigned to the "family-group"). For
family-group names the relevant Article is 36, for genus-group names it is
43, and for species-group names it is Article 46:
46.1. *Statement of the Principle of Coordination applied to species-group
names*
A name established for a taxon at either rank in the species group [i.e.:
species and subspecies - my note] is deemed to have been simultaneously
established by the same author for a taxon at the other rank in the group;
both nominal taxa have the same name-bearing type, whether that type was
fixed originally or subsequently.
In the case you are describing, it seems to me (without looking at the
detail) that a species-group name for the desired taxon has already been
established (i.e. concolor, authorship di Caporiacco, 1933, presented in
parentheses if not in its original generic placement, so to assign any new
name would be proposing a junior synonym (providing that the type of
concolor falls within your desired circumscription for the proposed new
species).
