OK. Just start playing some of your favorite tunes on your iPod (or weapon of choice). You can hook it up to a speaker and anybody can listen or you can lend it to friends. Guess what will happen if you decide to put some of it on tape and sell the tapes.

  red herring ... an author who can selectively give away copies is a *very different* situation to *anybody* having free access via BHL (only in the latter case is the paper truly freely available) ...

  Just because something is made available for free does not mean that it is proper (or legal) for someone else to copy it for profit.  As an example, Zootaxa (and other journal) authors receive a .pdf of their papers. These they can freely distribute to colleagues. They may not, however, allow anyone to copy them for profit.

  An unstated element in this thread is that Nabu reprints are often of poor quality and sometimes lack plates, etc.  That, of course, has nothing to do with the legitimacy of their actions.
