I COMPLETELY agree!  In fact, I want the Code to completely divorce itself from anything whatsoever having to do with "publication" for new names & acts going forward.  We're stuck with dealing with the legacy, but the advent of electronic publication is making it MUCH harder to maintain any sort of Code governance or reliance on the publication process itself.  This is actually the main reason behind my advocacy for the alternative system.

All of this goes away if the Code separates the process of governed nomenclatural actions from "publication" completely. (For new names, at least; and eventually for old names as well, once a LAN is robustly incorporated and fleshed out).
