The whole reason that rather unusual examples such as these are included in 
the Code is to use them as guidance as to how to interpret what may be 
difficult issues to understand.

I do agree with you that the wording of the example you took issue with is 
not exactly ideal; but as with all Code issues you have to look for key 
words, either in the example or in the Code Article that actually 
unambiguously tell you how to interpret them as long as you follow the chain 
of reasoning.
