[Taxacom] Reality check - lies and hate by academic fraud, plagiarism, etc.

All:

I do not know of any LEGAL actions in respects to taxonomy, but

I do know of Academic actions based on Academic standards.

Issues of classification are merely matters of Science, different 
hypotheses, etc.

But naming a taxon which has been available / publically assessable / etc. 
previously, is a form of plagiarism.

Example being, one publishes a new species that had been previously 
published. That new species was in a manuscript that the SENIOR author never 
lived to see published. The manuscript was widely available. One set of 
authors published it and credited the species to the deceased author. 
Another group did not***. The holotype was the same for both species 
described.

Unfortunately while it was a clear-cut case of plagiarism, the American 
legal system is costly, etc. So, not official action was ever taken against 
the plagiarizers, etc.

So, in respect to this issue of "... taxonomic vandalism, unscientific 
papers and the like ..." NOTHING will be realized.

There maybe Academic standards for conduct, in respects to things such as 
plagiarism and there may be copyright regulations, etc., the simple fact 
remains NEITHER are relevant as the legal system is EXPENSIVE and 
independent of the Academic system.

Oh, well ...

*** In the example I gave, the group who plagiarize the new species merely 
subsequently declared that they simply accept the original author was dead 
and therefore his work was irrelevant as it was never published.

Irrespective of the merits or not of Raymond's claims, one point has some
interesting generality when regarding McCord taking legal action "when
Wuster and Kaiser made repeated baseless claims to a global audience
against McCord’s taxonomy. These being his usual assertions of taxonomic
vandalism, unscientific papers and the like, all for the purpose of setting
himself up to steal naming rights for the large number of taxa formally
described and named by McCord and several associates of his."

Does anyone on the list know of other instances where taxonomists have
taken legal action based on arguments about how their taxonomic work was
treated by one or other researchers? In reference to the above quote, which
is a bit vague (and maybe Raymond can elaborate, in particular who made
assertions about taxonomic vandalism - Wuster or McCord), it seems that
McCord called in lawyers (to do what?) because his (McCord's)  papers were
characterized as being unscientific.
