There are significant differences between fossil-taxa and
extant taxa in the ICNafp, but the most important ones
are found in Art. 11.7 and 11.8: any name based on an
'extant type' (a non-fossil type) gets priority over any
name based on a fossil type. So, a taxon with both fossil
and extant representatives will have a name based on an
extant representative (or, if it does not, it will as soon as
somebody publishes such a name). This does not apply
to diatoms.
