Where do you see this?  The Google Maps/Earth ToS only goes up to 7,
and the general terms section 10 refers to decompiling the source
code.  Section 2(f) does say you can't "use the Products in a manner
that gives you or any other person access to mass downloads or bulk
feeds of any Content, including but not limited to numerical
latitude or longitude coordinates, imagery, and visible map data",
but I don't see any way that taking individual points, even a lot of
them, could be interpreted as mass downloads or bulk feeds.  As I
see it, it's referring to duplicating the whole content of the map
system.
