Whether the Codes have jurisdiction here is an interesting question.
Clearly, there is no such thing as "real jurisdiction", just as there is no
such a thing as "slightly pregnant".  In the case of the ICZN this is
simple, as the ICZN does not apply to higher ranks

However, the ICBN does cover all scientific names of taxa (i.e. in all
ranks), so the matter of rank is not relevant. Also, the ICBN applies to
"all organisms traditionally treated as plants" (Preamble 7), so the mixed
nature, too, is not really relevant. If you want to free it from the
jurisdiction of the ICBN it would be more poroductive to argue that by
publishing a new Kingdom Haeckel deliberately put his new group outside the
framework accepted for plants and thus out of the reach of the future ICBN
...
