I'd forgotten the names of the perpetrators in the Wells and Wellington
case. I don't see that this case establishes any precedent regarding ICZN
article 8(a)(2) ["must be obtainable, when first issued, free of charge or
by purchase"]. While limitations of access are mention in the introduction
of the decision [Bulletin of Zoological Nomenclature 48: 337-388 (1991)],
these limitations are not cited in the Commission's conclusions about the case.

Having served on the Commission, you know the sense of the commissioners'
unpublished arguments, so perhaps article 8(a)(2) really is toothless. I
still think that a well chosen case focused solely on that article might
prevail.
